| Letter of Support This is a Letter of Support Regarding the Establishment of the Parasailing & Watersports Guidlines & Regulations and Trade Licensing of Andy Lepel , d.b.a Aqua Fun Parasailing and Watersports, in San Pedro Town, Belize. As an Established Resident and or Citizen of San Pedro Town, I believe that Activities such as Parasailing & Watersports, should only be Conducted by Experienced, Competent, Operators which Possess Experience, Credentials and Safe Track Records. In such, After Reviewing and In Recognition of the Attached Documents, I lend a word of Support to Andy Lepel as being Safe, Experienced, Competent Parasailing & Watersports Operators who Possess the Necessary Experience, Credentials and History to Safely Conduct Parasailing & Watersports Activities in and for San Pedro Town. Operator & Crew Training, Requirements and Credentials a.) Parasailing Activities shall not be Permitted wherein the, the Captain / Master of the Parasailing Vessel (Vessel) has not under, Direct Proffessional Supervision, Successfully Performed 500 Full Rotation / Launch & Recovery Flights, Withhout Incidence b.) Parasailing Activities shall not be Permitted wherein the, Crew Members of the Vessel have not been Proffessionaly Educated in Parasailing Operations, Safety Procedures. c.) Parasailing Activities shall not be Permitted wherein the, Crew Members of the Vessel are not a member of a Credible & Recognized Drug Consortium or have undergone a Pre-Employment Drug Screen and have Agreed to Random Drug Screens. d.) Parasailing Activities shall not be Permitted wherein the, Crew Members of the Vessel have not undergone a formal C.P.R. course from a Credible & Recognized Association. 2.) Weather Conditions a.) Parasailing Activities shall not be Permitted wherein the, Winds are or are Reasonably Expected to Exceed 15 knots. b.) Parasailing Activities shall not be Permitted wherein the, there is or is Reasonably Expected to be, any Presence of Thunderstorm or Lightning Activity within 10 Nautical Miles. c.) Parasailing Activities shall not be Permitted wherein there, is an approaching Frontal Bounary visible within Five Nautical Miles. 3.) Pre-Flight Passenger Safety Orientation & Safety Speech b.) Parasailing Activities shall not be Permitted wherein, the Captain / Master of the Vessel has not Implemented a Pre-Flight Passenger Orientation & Safety Speech, which shall include, b-1.) A Thorough Pre-Flight Explaination and Familiarization of all Equipment. b-2.) A Thorough Pre-Flight Explaination and Familiarization of all Procedures. b-3.) A Thorough Pre-Flight Explanation and Instructions in the Event of Mechanical Failure and Recovery is not on the Vessel 4.) Operating Areas a.) Parasailing Activities shall not be Permitted Outside the Boundaries Previously Established by The Ministry of Tourism & Civil Aviation. b.) Parasailing Activities shall not be Permitted , Within 300 Feet of the Shoreline, any Structure or Vessel, including Launching / Recovery,and Inflation / Deflation of the Parasail. c.) Parasailing Activities shall not be Permitted wherein the, Total Height from Ocean Surface Exceeds 400 Feet. d.) Parasailing Activities shall not be Permitted wherein the, Parasailing Vessel travels Within 300 Feet of the Reef. e.) Parasailing Activities shall not be Permitted wherein the, Activity is Outside of the Reef & Seas Exceed 4 Feet. 5.) Operating Capacities and Limits a.) Parasailing Activities shall not be Permitted wherein the, Total number of Passengers Exceeds 3 Passengers Per Rotation. b.) Parasailing Activities shall not be Permitted wherein the, Maximum Amount of Weight is Less than 110 lbs. c.) Parasailing Activities shall not be Permitted wherein the, Maximum Amount of Weight Exceeds 500 lbs. d.) Parasailing Activities shall not be Permitted wherein the, Dipping Process Exceeds 100 feet of Distance from the Parasailing Vessel. e.) Parasailing Activities shall not be Permitted wherein the, Passenger is Under the Age of 7 Years. 6.) Operating Hours a.) Parasailing Activities shall not be Permitted within, 1/2 an Hour before Sunset. b.) Parasailing Activities shall not be Permitted within, 0 Minutes Before Sunrise. 7.) Parasail Vessel & Equipment a.) Parasailing Activities shall not be permitted wherein the, Vessel is not is not Specifically Designed for Parasailing and is not Equiped with a Hydraulic Windlass Winch and Motor, for Launch & Recovery to and from the Flight Deck of Vessel. b.) No Parasailing Activities shall be permitted wherein the, the Activity Provider does not Possess Proffessionally Approved and Well Maintained Equipment including but not Limited to Parasails, Harnesses, Towline, Rigging, Life Preservers, PFDs, Ship to Shore Communications, First Aid Kits & Fire Extinguishers. 8.) Vessel & Equipment Maintenance and Inspection a.) Parasailing Activities shall not be Permitted wherein the, Parasailing Activities are not Documented by a Daily Parasail Flight Log, which shall Contain the Total Number of Passengers, the Wind and Weather Conditions and a Daily Vessel & Equipment Inspection Log, which shall be supplied to any competent Govermnent Agency within 48 hours after Request is made. *See Attached Logs 9.) Insurance, Indemnification & Liability a.) Parasailing Activities shall not be Permitted wherein the, Activity Provider does not Possess the Minimum of $500,000.00 Each Occurence and $1,000,000.00 in Aggregate Liability Insurance Policy. b.) Parasailing Activities shall not be Permitted wherein the, Activity Provider does not, Additionally Insure San pedro Town under the the Above Liabilty Insurance Policy. Express Assumption of Risk Associated with use of Parasailing & Related Watersport Activities I, print your name(s) do hereby affirm and acknowledge that I have been fully informed of the inherent hazards and risks associated with parasailing, water transportation to and from the parasail vessel and other such related water sport activities to which I am about to engage, including but not limited to: 1) Changing water flow, tides, currents, wave action and ship’s wakes; 2) Collision with any of the following: a) Other participants, b) the watercraft, c) other watercraft, d) man made or natural objects, 3) shuttle boat 3) Wind shear, inclement weather, lightning, variances and extremes of wind, weather and temperature; 4) My sense of balance, physical condition, ability to operate equipment, swim and/or follow directions; 5) Collision, capsizing, sinking, or other hazard that may result in wetness, injury, exposure to the elements, hypothermia, impact of the body upon the water, injection of water into my body orifices, and / or drowning; 6) The presence of insects and marine life forms; 7) Equipment failure or operator error; 8) Heat or sun related injuries or illnesses, including sunburn, sun stroke or dehydration; 9) Fatigue, chill and/or reaction time and increased risk of an accident I specifically acknowledge that I have been trained in the safe use of parasailing & water sport equipment to my complete satisfaction and I am physically/mentally able to participate in the water sport activities to which am about to engage. I specifically waive any defense insofar as this contract is concerned that may arise as a result of any state or local law and/or regulation or policy that may impact its enforceability. RELEASE OF LIABILITY, WAIVER OF CLAIMS AND INDEMINTY AGREEMENT In consideration of being allowed to participate in the above-described parasailing & water sports, transportation, and parasailing activities, as well as the use of any of the facilities, specifically, including water transportation (shuttle boat) to and from the parasail vessel and the use of the equipment of the below listed releases, I hereby agree as follows: To waive and release any and all claims based upon negligence, active or passive, with the exception of , wanton, or willful misconduct that I may have in the future against all of the following named persons or entities herein referred to as releasees. Sand And Watersports, LLc, Aqua Fun Parasailing Ltd, San Pedro Water Taxi, San Pedro Town, its owners as individuals, the Vessel Badfish VIN # PZAL0279G8998FL9848HD, To release the releasees, their owners/officers, directors, employees, representatives, agents, and volunteers, and vessels from liability and responsibility whatsoever and for any claims or causes of action that I, my estate, heirs, executors, or assigns may have for personal injury, property damage, or wrongful death arising from the above gross negligence. By executing this document, I agree to hold the releasees harmless and indemnify them in conjunction with any injury or loss of life that may occur as a result of engaging in the above activities. By entering into this agreement, I am not relying on any oral or written representation or statements made by the releasees, other than what is set forth in this Agreement. I hereby declare that I am of legal age and am competent to sign this Agreement or, if not, that my parent or legal guardian shall sign on my behalf and that my parent or legal guardian is in complete understanding and concurrence with this Agreement. I have read this Agreement, understand it, and I agree to be bound by it. _____________________________________________________ Signature of Adult Participant (or Parent/Guardian) Print Name of Adult Participant (or Child Participant) Date _____________________________________________________ Signature of Adult Participant Print Name of Adult Participant Date DECLARATION OF FITNESS TO PARASAIL I hereby declare that I am physically fit; I do not and have not suffered from any of the following conditions, which I understand may lead to a dangerous situation with regard to other persons or myself during Parasailing: Epilepsy, fits, severe head injury, recurrent blackouts or giddiness, disease of the brain or nervous system, high blood pressure, lung or heart disease, recurrent weakness or dislocation of any limb, diabetes, mental illness, drug or alcohol addiction, recent back injury, arthritis and severe joint sprains, chronic bronchitis, asthma, rheumatic fever, thyroid adrenal or other glandular disorder, recent blood donation or any condition that requires the regular use of drugs. I hereby declare that I have no physical or mental condition that should preclude me from participating in my chosen activity, that I am not participating against medical advice or treatment, and that I have not been diagnosed by a registered doctor as having a terminal illness. I further declare that in the event that I feel ill or unwell, have any physical complaints whatsoever or if any injury is sustained or any kind during the course of Parasailing activities, I will notify the Captain of the Parasail vessel immediately and before disembarking from the vessel. Watersports Guilines &Regulations 1.) Crew Training, Requirements & Credentials a.) Watersports Activities shall not be Permitted wherein the, Crew Members have not been Proffessionaly Educated in Watersports Operations, Safety Procedures. b.) Watersports Activities shall not be Permitted wherein the, Crew Members are not a member of a Credible & Recognized Drug Consortium or have undergone a Pre-Employment Drug Screen and have Agreed to Random Drug Screens. c.) Watersports Activities shall not be Permitted wherein there, is an approaching Frontal Bounary visible within Five Nautical Miles. 3.) PWC Safety Orientation & Speech a.) Watersports Activities shall not be Permitted wherein, the Activity Provider has not Established a thorough PWC Safety Orientation & Speech Program, which shall include, a-1.) A Thorough Explaination and Familiarization of all Equipment. a-2.) A Thorough Explaination and Familiarization of all Procedures. a-3.) A Thorough Explanation of Boundaries, Distances, Rules of the Water and Instructions in the Event of Mechanical Failure or Capsizing. 4.) Operating Areas a.) Watersport Activities shall not be Permitted , Within 300 Feet of the Shoreline, any Structure or Vessel, including but not limited to other PWCs, Anchored Vessels, and Non-Motorized Vessels. b.) Watersport Activities shall not be Permitted wherein the, Activity Provider does not keep on stand by 1 Rescue / Chase Vessel and if more than 2 PWCs are operating simultaneously, the Activity director shall place a Qualified Crew Member on the Rescue / Chase Vessel to Actively Observe and Chaparone the PWCs c.) Watersport Activities shall not be Permitted wherein the, PWC travels Within 300 Feet of the Reef. d.) Watersport Activities shall not be Permitted wherein the, Activity is Outside of the Reef & Seas Exceed 4 Feet. 5.) Operating Capacities and Limits a.) Watersport Activities shall not be Permitted wherein the, Total number of Ocupants Exceeds 2 Passengers Per PWC. b.) Watersport Activities shall not be Permitted wherein the, Maximum Amount of Weight is Less than 90 lbs. c.) Watersport Activities shall not be Permitted wherein the, Maximum Amount of Weight Exceeds 400 lbs. d.) Watersport Activities shall not be Permitted wherein the, the Driver is Under the Age of 18 or Passenger is Under the Age of 7 Years. 6.) Operating Hours a.) Watersport Activities shall not be Permitted within, 1/2 an Hour before Sunset. b.) Watersport Activities shall not be Permitted within, 0 Minutes Before Sunrise. 7.) PWCs & Equipment a.) Watersports Activities shall be not be permitted wherein the, Activity Provider does not Possess Proffessionally Approved and Well Maintained PWCs and Equipment including but not Limited to Life Preservers, Emergency Signals, Whistles, First Aid Kits and Fire Extinguishers 8.) PWC & Equipment Maintenance and Inspection a.) Watersports Activities shall not be Permitted wherein the, Watersport Activities are not Documented by a Daily Rental Log, which shall Contain the Total Number of PWC Drivers & Passengers, the Wind and Weather Conditions and a Daily PWC & Equipment Inspection Log, which shall be supplied to any competent Govermnent Agency within 24 hours Upon Request. *See Attached Logs 9.) Insurance, Indemnification & Liability a.) Parasailing Activities shall not be Permitted wherein the, Activity Provider does not Possess the Minimum of $500,000.00 Each Occurence and $1,000,000.00 in Aggregate Liability Insurance Policy. b.)
